It will be interesting to see if there was legal advice sought. We do it on a regular basis and have solicitors on 'speed dial'.
It looks like the IP will only call the variation if they have the funds on hand but given their previous delays I can understand your reluctance to give themt he money. The delays mean more monthly payments being made which is effectively costing you so perhaps you should tell the IP that you will lodge the £15k once you have received a copy of the variation report and the other £7k will be held by your own solicitor.
You should also consider reducing the offer by any further monthly payments but that is one for you to decide and may not be an issue if the IP goes ahead quickly with the report.
I agree with Michael's comments - ask them for a copy of their legal advice or, if there isn't any, under what basis they believe all of the money is due into the IVA estate. That will give you a starting point to challenge. If your own lawyers are not insolvency specialists I can recommend some experts for you to battle this if necessary.
Thank-you again for all the comments, I shall be asking to see a copy of the advice given, the variation meeting has been scheduled for the 19th January, about 4-5 weeks later than hoped but can cope with another payment, it's the end result I'm after and as yet haven't paid the funds across and as yet haven't been chased for them either
Good news for me, I've had my offer accepted by my creditors, have just transferred the funds to my IP, they now have 3 months to finalise all the paperwork etc which will bring my IVA to a finish - thanks to everybody who commented and good luck for the future for everyone still in an IVA
