I asked a couple of questions yesterday, and dont want to repeat myself but want to make sure everything is in order for me to complete my BR submission.
I confirmed with my IP this morning that i would be going ahead to petition for my own BR as 15 months into my IVA, i cannot afford the payments (mainly due to the 'jigging' about with my expenditure outgoings to make the IVA work!). My IP has cancelled my Direct Debit and will inform all my creditors of my descision.
I now want to press ahead with BR asap (hopefully before my creditors start chasing me again!). I am going to use the money that was going to be my next IVA payment to pay the £485 BR costs, so i should be able to do this when i get paid next week.
I have almost completed the on-line BR forms, but want to just make sure of something first. It says that when you press 'submit', a copy of the forms will be electronically transferred to the Insolvency people, and then i will get new forms back to complete and print off.
Do i need to make an appointment with my local county court (York) before i submit my forms, or can i wait to print off my forms and then make the appointment after? Do my submitted forms go to the head office of the Insolvency register or do they go to the court i wish to attend?
Also, when i started my IVA, i destroyed most of my loan and credit card statements etc (as i never wanted to see them again and didn't think they would be needed!). I did have my complete list of creditors and what i owed and full address etc as i found these on my IVA proposal,so i have completed the details on the on-line application BR, but i do not have all the statements etc. Has anyone else who has been through BR and gone to court also not had all the paperwork? Is this vital or can the OR get all the info from the name and address of each creditor?
