Cleardebt
I made my last IVA payment at the end of January this year after a year of debt management and an IVA that lasted 6 years. WHOOOOHOOO or so I thought at the time. My IVA had been passed between three different IVA companies ending up with Cleardebt sometime last year.
I rang up a very helpful lady called Jane at Cleardebt after I had made my last payment and she said it would not be to long before I was issued with a completion certificate.
Then at the beginning of April I get the bombshell letter that many others have received, stating that they could not issue the completion certificate until after they had made claims for miss sold PPI. I protested that I had not been miss sold PPI and that any PPI I had taken out I had entered into with my full knowledge. I said that I did not want to make a claim for PPI now or in the future and would sign a statement to that effect.
I complained about the timing of this claim asking why was this not done 3-4 months prior so that it would have been completed before the last payment of the IVA.
Long story short, I was told that unless I signed authority for a PPI claims company to make claims on my behalf that the IVA that I stopped paying in January would fail and I would be thrown to the mercy of my creditors and face possible bankruptcy!
Not taking kindly to being threatened like this I did however reason that the sooner I got this over with the sooner I could move on.
Now here I am some 6-8 weeks after returning the authority forms that I get a letter from the claims company saying that the some of the account numbers that I had given them had not been recognised. The account numbers had been provided by Cleardebt so if they are wrong it is an error made by Cleardebt!
They now have to make a fresh claim with the correct information which will drag this on for another 2-3 months.
I am not sure what the point of this post is other than to blow off some steam and perhaps share the problems that I am having to get my completion certificate!
I can only speak from my experience but I would recommend you stay away from Cleardebt and their bullying tactics!
Also if you are in the last year of your IVA then I suggest that you bring up with your IP about miss sold PPI so it can be resolved before your final payment.

Hi Heretoday, I am so sorry to hear of the troubles that you are having. I would look at making a complaint to Cleardebt to ask why they didn't mention this early.
I would have thought that they could still issue your complition certificate to you and if you do not believe you were missold PPI why should you lie and say you were!
I have emailed Size5 and hope for the best and will update this post if and when I get a responce.
On the grand scheme of things whether I get this resolved in 1 week or 3 months probably does not matter, however when you have struggled with debt for years, then enter debt management for a year then a further 6 years of an IVA it is physiologically important!
I now have real mixed views on whether an IVA was the right option! At first I wanted to pay back as much as I could but have a light at the end of the tunnel. I guess I still feel the same way but in this case Cleardebt keep moving that light ever further away!
I am deeply disturbed by the way I have been treated, no blackmailed by Cleardebt!

We're with cleardebt and have always found them really helpful and willing to sort out any issues. The PPI thing is quite recent and we did have a letter from cleardebt about it. My recollection was that an IVA intention is to pay back as much as possible and assets at the time of entering the IVA are used as part of that. Any PPI claim would relate to pre-IVA times when you had credit and so would be an asset at that time. IPs have a duty of care to both parties in an IVA and so are legally bound to recover what is applicable. Failure to do so would mean that they were not doing their job properly.
This is from memory so I do stand to be corrected on that.
1. Being forced into making a claim for miss sold ppi against my will. I would use language such as threatened, intimidated and blackmailed into doing this. If they and I are legally required to make such a claim that is one thing,
2. The timing of this claim, here is a link to Cleardebt’s website dated May 2011 where they seem aware that the banks are no longer contesting claims for miss sold ppi and that any claims could go into benefitting the creditors of the IVA.

Why in my case have they waited until the beginning of April 2012 to make a claim?
Can any one answer if Cleardebt have broken any kind or rule or law by forcing me against my will to sign authority for a claims company to make a claim for miss sold ppi?
