i need childcare for my daughter for me to go back to work, the only person i trust is a close friend, and i will be paying her instead of going with a childminder that i will have met once or twice and wouldn't at all be comfortable leaving my only child with, will my ip accept that i have to pay someone who isn't a registered childminder? if i can't then going back to work will be a no go, and i am afraid that bancrupcy will be my only option :(

please help :(

Hi
I can't see a problem with this at all,you will need to talk it over with your IP and as long as you can continue paying into your IVA all should be ok.

I am going to become a registered childminder myself and thought this may help.

In the eyes of the law, anyone who cares for other people’s children aged under 8
on domestic premises
for more than two hours in any one day
for payment or reward
must be registered as a childminder. (Nannies who are employed to look after the children of more than two families are also required to register as childminders.)

The only circumstances in which childminders do not need to be registered are:
if they are blood relatives of the child or children in their care (whether whole blood or half blood)
if they are related “by affinity” to the child or children in their care (e.g. step parents, step siblings, aunts and uncles related by marriage)
if they have parental responsibility for children in their care (e.g. if they have obtained a residence order or adoption order in respect of the child or children)
if they are caring for children between the hours of 6pm and 2am
if they are foster parents fostering the children in their care (however, if they are caring for additional children whom they are not fostering, they must then be registered

Forgot to add, your friend if not related in any way, can do a childcare course for as little as 30.00 and its a fab way to earn money whilst staying home with the children, she is also covered then for any accidents problems that may occur whilst your child is in her care. You have peace of mind and also can bring up any issues you may have without hurting her feelings as it would be in a professional manner!

This is what I am doing, my friend has 3 children she wants me to look after and I felt it would secure what we are doing and not interfere in our friendship.

There is not a problem with this from an IP point of view, so long as you can demonstrate that payment is actually being made, but 63k raises some interesting legal points for you to be aware of.
