Hi, very new this, but we are so glad that we have come across thi site, you think that you are alone and holding a deep secret from the world! - Our IVA company we believe has not been the best and mislead us on many issues, and we tied to this at the moment, but is there a way we can change IVA companies or get out early? Thanks

Welcome to the forum.

Are you actually in an IVA or are you in the initial stages of proposing one?

It is notoriously hard to change IP once in an IVA as this is a lengthy and expensive process. The best route would be to try and come to a solution with your current IP.

Please post some more details on the problems that you are facing and we can advise further.

Hi - We have had a mixyure of problems when setting up, from dates being messed around, but the more recent ones are paperwork going missing and this has happened with recorded delivery paperwork. Just recently we had a phone call and got a letter to say that we were one month in arrears, even though we have been in the IVA for 16 months, when I called they said that this was from when we set the IVA up they made a mistake and did not take payment, I was told that they were not a debt company but I would be in breach if I did not pay them, so I have agreed to increase my payments over the next 6 months. The real problem is I guess, is that if I have to stick with the IVA I wanted it over 3 years and not 5, and eah time i suggest this, I get fobbed off. I may sound ungrateful, but we may be in a postion to move abroad in 12 months and I wanted the IVA to end as and if we moved abroad.

Sorry to hear about all the problems you have been having. I still feel that sticking with this IP and trying to resolve these issues is the way forward though.

The creditors will always want you to pay to the best of your ability, usually up to a period of 5 years (or 4 years payments and an equity release). If you can come up with a lump sum offer of an amount more than the original agreement you may be able to finish your IVA early.

It will be nigh impossible to change your IP, and you would not have got an 3 year IVA accepted by creditors. The issues you seem to be having with the IP appear to be relatively minor (I appreciate to you they are a complete irritation), but stick with it, all will be worth it in the long run.

Just to echo what Melanie has said and try and keep a good communication line with your IP because if you want to settle your IVA early you will need their full support,however you should always get this regardless.
