can we claim the money for a bounced cheque?

A cheque was received 25/01/08 and was dated 04/01/08 this was banked. The company entered into liquidation 28/01/08 and the cheque was stopped with the reason 'Payment prevented by insolvency act proceedings' do we have any recourse to claim the money for the bounced cheque?

Probably not.

However, can you please clarify - when you say "went into liquidation on 28/1/08" do you mean that that was the date of the creditors meeting? Did you received notice of the meeting?

I'm afraid that you are unlucky, you will be an unsecured creditor for your bounced payment.

Sadly, I must second Philips view, unless on the offchance your cheque was for wages. - I assume you weren't a former employee?

No the cheque was not for wages.
