Can I still take out an IVA if overseas?

Hi
i am now living permenatly overseas and have been trying to pay off my uk debt for 3 years. I can't keep up the repayments anymore and as I am not eligble for a loan in the uk and don't have the income here for a consolidation loan I think an IVA is the only option. Can I still take out an IVA if overseas? Also all the mail is going to my parents address and I don't want them to know about the IVA can I get mail sent overseas? thanks

An IVA is possible if you live overseas as long as you have a permanent address in the UK which can be used by the court. Some of the post would possibly be able to be sent to your address overseas but the IVA would have to be registered to your Parent's home.

The last post is not strictly true. I was living abroad when i started my IVA and lived there for most of the first year and the registered address was my overseas address. In fact on the insolvency register my overseas address is still on there.
I had a uk bank account but no registered address

I am happy to stand corrected on this one and would like to thank Steve for his input, however I was under the impression that a uk address was needed for court purposes.

Any others wish to add to this discussion?

Hi Steve

Correct me if I am wrong but are you not HM Forces? If so, then there is special dispensation for you as you are actually still deemed to be a resident of the UK whilst serving overseas. Your application was, I assume, made in the High Court?

So you are both technically right - but this only covers HMF personnel.

Yes Melanie.
I am HM Forces and my IVA was at the high court,
but i didnt have a UK address.
I didnt know i was a special case though.

As a member of the armed forces you are granted special exemption from this and would be able to propose an IVA with your overseas address.
