Can i claim my unfair bank charges back

Can i claim my unfair bank charges back from the same creditors i have entered into an iva with, most of them have sold on the debt and will it affect my iva?

Hi Carl and welcome to the forum. I think you can try and claim back unfair bank charges, but if you are successful whilst in an IVA the money will be classed as a windfall and will have to be paid into your IVA. This will reduce your overall debt, but unless you are paying back 100p in the pound it is unlikely to reduce the length of your IVA.

The refund I got from my bank over miss-selling loans was just knocked off my loan balance (by the bank).

So I started my IVA owing them roughly 13K. Now that balance is down to £9K (even though they havent actually recieved any payemnts yet from IP), so when my payments are dished out by my IP, they get a bit less and everyone else gets a bit more.

So dont really have much effect, but I felt better for it anyways.

The only way I can see me personally seeing any benefit, is if I am in a postion to offer a full & final in the future. I would have to offer less, to maintain the same amount in the £ as per my original agreement.
