I was in a iva that completed in 2011, with dfd, I received completion certificate, then some monies that were owed from ppi came to light 2016, at the time Laura Marshall from dfd dealt with it, I was able to keep the ppi money I have emails that I kept, now some money was paid in 2017 not much but we received the letter from bank, when I contacted dfd they had been taken over by aperture, I emailed at the time, no response, they got in touch recently to advise they had a refund it was £10, I asked about the other money and they say its been paid to creditors, dfd in the past stated I could pursue and keep any monies as a Claus was not written into the iva, could anybody advise what that Claus would be and where to find it on my chairmans report, aperture are not being very helpful and keep sending me an email saying any monies will be divided between creditors and dfd stated I coukd keep any ppi, do I'm really confused, and unsure how to take it forward, I also think. Other ppi has been sent to them now but font know what has happened to it or which creditors it has gone to, should I receive a report of who has had any money. You are entitled to get an accounting fior the money and, I would have thought, your IP would need to keep accurate accounts for business purposes as well.
The fact that DFD were happy to let you keep the money and that Aperture won't is just down to the differing practices of either IP and you have to abide by that. In reality Aperture are correct and DFD were being generous.
This 'missing clause' could be a red herring as there are several ways PPI could be taken into the IVA and, indeed, would be dealt with undr standard terms and conditions that apply to these arrangements anyway.
