can I ask for defaults to be removed now ?

My IVA was completed after the five years and was removed from my Experian and Equifax credit files on 21/08/2008(six years after started). However Equifax still have 5 defaults, all with Max Recovery, on my file that were included in the IVA, all have correct default dates on them..why would these still remain on my file and can I ask for them to be removed now the six years have passed?

I would imagine that you can contact equifax and tell them to update your file.
Discharged today the 8th feb 2012. View is much brighter now.
Continuing to rebuild our credit worthiness.

Your defaults will come off your credit record six years after they were put on the file.When will this be ?

Hi Andy,

My IVA start date was 21/08/2002 and my IVA came off my Experian and Equifax files, as did all my other defaults, on 21/08/2008 six years from the start date.
The 5 Max Recovery defaults all have the correct default start date ie 21/08/2002 but are still showing on my Equifax credit file.
Do I have a right to ask Equifax to remove these defaults as the six years have now passed, all be it only by a few days. It seems strange that they have removed my IVA and all other defaults but not these 5 that are with the one company.
I would like to call them up tomorrow so any advice you could give would be most welcome.

Yes, they should drop off automatically. If they are still there at the start of next month, I'd write to them to ask they remove them under the 6 year rule.

Perhaps they're just a bit slow in updating the files.

Yes Jan, I think they update the CRA files monthly, so it should be sorted by next month.

Thanks for the replies.I am sure they will come off the credit files eventually but I just wondered if I have any rights to ask them to remove them now as the six years have clearly passed.
I am off work next week and hoping to go into my bank to see if I can now obtain a proper full bank account. I would prefer if all my past defaults etc were no longer showing on my credit files.I know someone has posted they may be a bit slow updating but I find that strange as all my other defaults plus my IVA have been removed from the file. How can they have missed just these ones?
Think I will call them in the morning and find out if they are prepared to remove the details.

If you want a normal bank account with overdraft then you definitely need to get those defaults off your credit file first before going to the bank.

They will credit check for a new account.

No harm writing to the CRAs, if you need templates for this get hold of a booklet called "No Credit".

I suppose I really want to know if they will do this straight away at Equifax rather than all the the letter writing. They can see from the date on the defaults that they should no longer be on my credit file, do they ever "have the power" to sort things out on the phone?

I don't think so, its all to do with data protection. They will not discuss CRA files on the phone, after all how do they know you are who you say you are. Its for your protection just as much as theirs.

I am trying to get the defaults sorted out on my CRFs after my BR discharge and I'm having to write to each creditor individually.

Did you have the report from them in the post first of all, were you able to provide them with a reference number?

I have my reference number from my on-line application. I have decided to call them in the morning and see what they can do if anything. Will update when I have tried this approach.
