Hi everyone, hope you are all well. I was hoping for some guidance.
My brother has told me that in the event of himself and my S in law dying that I would be a joint trustee to my nephews estate. Will my IVA effect my capacity to take this role?
Thanks in advance.

Hi, as far as I know you will be OK. As a Trustee you administer the estate, but do not own any of it.

Hopefully the situation will not arise.

I'm not so sure, I didn't think you could act as a trustee while in IVA.
Completion certificate received 31 March 2012.

You are not allowed to be a trustee of a charitable body -- but I think administering an estate is different.

No - but you should make sure that all other parties to the trust are aware of your financial situation.
