bankruptcy question

I would appreciate any reply from anyone with Bankruptcy knowledge. If I had old debts which had defaulted and I was no longer making payments, could I go bankrupt without involving a new partner.Old debts amount to 16k. Joint incomes are £2400 and after living costs etc looks like between us there would be about £500-£600 disposable income. However in effect new partner would be paying towards my old debt. What line would the OR take.Would appreciate thoughts.

Your partner won't have to contribute to your debts.

When I completed my forms I entered the amount my partner contributes to the household expenditure, not his total income. I did the same when I completed another I & E and I was told this was ok. If you have to pay into an IPA the payments are made from your surplus and your partner won't have to contribute.

What would normally happen is that an overall income and expenditure be taken for the entire household and any surplus income remaining is apportioned to each partner given their level of income to the property. Therefore your surplus is your surplus and your partner keeps hers/his.

My IPA was set without the OR knowing what my partner earns, just how much he contributes, which is more than me!

How can they apportion the surplus remaining - surely my surplus is mine and my partner's surplus is his? He actually earns less than me, but contributes more to the household as the house is his.
