Hi can somebody help me. Our iva was accepted on June 18th 2009. Our contract stated we would pay for 60 months and in the 54 month look into either releasing equity in our property or paying another 12 months. Our iva was with Rsm who then were Rsm tenon and now grant Thornton. We have paid every month and waited to hear from them after numerous phone calls. Anyway in sept 2014 we got a letter requesting wages info, property info and mortgage info. I sent it all by sept 10th. I have called twice a month and nothing. Still nothing as of yet. I am upset that it has taken them now 7 months and I have heard nothing. So what do I do, as if I have to pay another year that's unfair as they have delayed it 7 months already. Surely there must be something I can challenge.
This does seem like a long time and you should possibly try and put a bit more pressure on GT. They did have a forum representative here for a while but no longer so you will need to contact them again.
Send an email or a letter and copy your IP in and hopefully this will get things hurried along for you.
I too am with GT and in a similar situation. My final payment was in Feb 2013 and i have no equity in my property so IAW my original T&C's my property has been excluded and no extension was due. This should have been an end to my IVA but i have now found out that some of my creditors have only just submitted their claims one of which has doubled since my Statement Of Affairs was sent in at the start of my IVA. My IVA was based on a minimum premium which i thought was based on the figures given at the start of the IVA, but GT are now saying that they have to have a creditors meeting for them to vote on accepting a reduced premium due to their final claims been more than 10% of my original debt. It has been 2 years since my final payment and 2 years since my IVA was originally due to finish IAW my original T&C's.
I found myself in a similar situation, although not with GT. Ultimately after several months of emails and queries unanswered I sent a recorded letter to them stating that in the absence of an written statement to the contrary I would suspend further payments on month 60 as I felt that I had fully complied with all of the requirements of my agreement. I continued to set aside the monthly payment 'just in case', but this did finally stir them into action. This may not be good advice for everyone, but it worked for me!
