I completed my IVA in June 2009 I am now being chased by Capital One as they are saying the debt collector that excepted the full and final offer last year were not paid in time by Payplan and I now have to pay the balance.
I defaulted on £478.00 at the start of my IVA the amount they want is £227.00 so they clearly have had some money.
A month or so after I made my full and final payment I had a letter from Credit Solution asking for £352.93 ref Capital One account after lots of phone calls and having to send all the debt letters to payplan the letters from Credit Solutions stopped.
Now a year down the line I have this letter from Capital and they have been so bad on the phone basically saying well payplan paid the debt collector late so even though the debt collector has taken that money I now have to pay the remainder
As my IVA is so old a receptionist at payplan will only send emails to the lady that looked after my case she will not transfer me and I just dont know what to do.
I am still paying my father back the full and final payment money so I can no way pay this money to Capital and why should I as I feel I made every effort to sort out my debts which is why I went into a IVA not bankrupt.
Any advice would be great.
This is not your problem and should be dealt with by Payplan. Tell Capital One you will report them for harrassment and advise Payplan to sort this out. The fact that your case is no longer live is irrelevant and do not be fobbed off.
Contact your IP directly as this should not be happening to you and any more correspondence from any creditors should be dealt with by Payplan.
Be firm with Capital One as Michael says. You don't owe them any money.
