2 months into IVA and debt collectors may be comin

Hi

I have been in my IVA since January with Debt Matters and now recently transferred to Payplan. All my creditors have advised that Debt Matters never contacted them with details of any IVA and they ALL are threatening to send debt collectors round. 2 of my creditors phone me almost everyday, I kept telling Debt Matters about this but obviously nothing was done, I have sincetold payplan but still no one has done anything..may be the backlog I don;t know. No one knows about my IVA and I am terrified of anyone coming to the house. One of my creditors sent a solicitors letter in February advising if I didn't contact them with payment within 14 days I would be taken to court, I heard nothing and last week they told me the debt colelctors would be coming. Another said If I didnt make a token payment of £17 then she would send the bailiffs round. Is this scare mongering..I was under the impression it would be illegal to contact me? Please help I can't take it anymore. Thanks

Hi Baby1 and welcome to the forum. Have you checked the insolvency register (www.insolvency.gov.uk) - your name should be on there along with details of your IVA. You can then refer your creditors to the register.

I'm on there... still says debt matters though. thanks for that I'll tell 'em next time the give me my daily 8pm harassment call... ;)

Hi Baby1 ... they are acting illegally by telephoning you, that you are in an IVA says that they have legally agreed to your offer of repayment (whether they voted to or not!) ... I wouldn't even bother entering into a dialogue with them ... life's too short and there are more important things out there ... just put the phone down on such calls, or set up caller display and don't answer any numbers you don't know the origin of.

Hi if it gets too much give me a call and I will get one of the team to phone everyone and give them grief and read the riot act - actually the harrassement section ( Section 40 of the Administration of Justice Act 1970 which will help you)
