Hi folks ... I've just received documentation from my first review saying I earned over £400 last year more than I am allowed. Because of this my IVA provider is asking for slightly over £200 which I can't pay. They have said I can pay in monthly instalments, but that still takes my monthly payments out of my reach. What I don't understand is even with a 5% cost of living increase my income is the much the same as it was when I took the IVA out. Petrol has gone up 15% ... my electric bill has gone up 50% food has gone up between 25 and 40%. I feel like I'm back to square 1 and my IVA provider doesn't seem to care. I can't even afford to go Bankrupt because I don't have sufficient funds to start the ball rolling. Any advice would be welcome.

Ray, I'm sorry to hear that you've got problems with your review.

I suggest that you speak to your IP again and tell him that your expenditure has gone up and you can't afford to make the extra payment.

Is it possible that they can just tag them on to the end?

If you were to consider going BR, then you would need to let your IVA fail, and the three months payments which you would miss, should be enough to pay for your fees.

I hope it doesn't come to that though - I'm sure your IP will be reasonable.

work expenses should not be captured under an IVA?

As long as the expenses are recompense for money already paid out, then they shouldn't be included in the IVA.

The present Mrs Wizz gets paid every 4 weeks ... not monthly and it has been this way since the IVA started. This means that at least once a year there will be 2 payments in 1 month and I will have made 2 payments to the IVA in that month too. The IVA people are calculating the payments I receive but not the payments I make to them. I've waited snce last Wednesday for a call back (promised within 48 hours) and have had to call them again today for some kind of help. I might as well have been talking to one of the debt collectors I used to talk to last year, for all the help I got. I'm seriously considering cancelling the direct debit and going bankrupt and to hell with them.

Sorry ... had to get this off my chest [:(!]

This seems a lot of hassle over a relatively small amount of money to an IVA but a lot to you. Contact your IP directly and explain your problems if you are not satisfied with the case manager. You should be congratulated on making it past the first year as this is when most fail if they are going to fail at all.

It would be a shame to lose over a year's payments and possibly still end up with a three year income payments order. There seems to be a minor problem that should be easily addressed and the IVA can continue which is to the benefit of all concerned.

Thanks Michael ... I've requested a talk with my IP ... but the answer was ... IP's don't talk to clients they're too busy. I have to deal with the accounts manager who doesn't seem abe to count. Remarkably, when they were setting this IVA up last April/May all I had to do to talk to the IP was pick up the phone and I was put straight through. Is there any kind of official ombudsman I can complain to, do you know?

This type of attitude really P's me off. An IP gets a great big wage out of you,yet they are so godlike that they cannot speak to you to answer a query!!!!!

Look up the IP's e mail direct using the link on iva.com and email them directly with your query and point out that you have had no end of trouble with accounts manager etc etc.

There are regulators that you can complain to but you should follow the in house complaints procedure first. If you ask for a copy of the grievance procedure it should solve your problem as no one wants a complaint to the regulators.

Ray, I am so sorry that you are still having problems.

Email your IP direct - if you use this link it will bypass the office staff and go direct. A lot of posters have had results by doing this.

Here we are ... 10 days later and umpteen phone calls by me ... and still no response and I've received my Annual Report today saying I'm in arrears and now owe £380. Apart from an agreed payment break I have never missed a payment. I really need advice on how to deal with these leeches.
