Hi,

Me and my partner have lived together (in rented accommodation) for the past 20 months and he started his IVA 13 months ago. We are now looking at moving to a new area and are having problems with the credit referencing agency that the new letting agent uses.

My partner has never defaulted on any of his IVA payments, nor his rent or other bills.

The reference agency that the letting agency is using, has stated that my partner is bankrupt - this is not true. My partner spoke to the credit reference agency (call credit) that the reference agency uses and they have the correct information - that my partner is in an IVA. The reference agency doesn't have an IVA option, so they have ticked the bankruptcy box! Is this legal and how do we go about ensuring that the letting agent is given the correct information? Also, should an IVA prevent somebody from renting a property?

All help would be gratefully appreciated!

Also, how long after your IVA ends can you get your credit rating back to 'normal'?

AN Iva stays on ur credit file for 6 yrs from the start of the iva

unfortunately some searches do come back bankrupt for an iva its happened to me when applying for a bank account. U could try a different landlord who doesnt do credit checks , or see if a statement from ur current landlord would help.

But surely thats illegal to mark somebody as bankrupt when their not?

Besides, most decent letting agents do reference checks!

We're going to offer our current landlord as a reference as well as offer up the IVA statements (to show that they're up to date) and also copies of bank statements. Hopefully that will help!!

It cant hurt. I dnont rent but there are lots of people on the forum who do , i'm sure one will be along soon to give u more advise on this.

Apparently some renting agency,s ask for six months rent upfront if you are in an iva or bankrupt.The only ones who would probably not credit check are the private landlords where I think your ref and bankstatments would reassure.
I totally agree they should not mark you as bankrupt cant somebody write next to the box iva and cross out bankrupt !

Hi
Unfortunately some banks and other organisations class IVAs and bankrupts the same.
Your best bet if you are not successful is to be upfront with the agency or as Angie states use a private landlord.

Will do!!

Luckily I have some savings, so it would be no problem to pay six months upfront and I am even willing to give bank statements to confirm my savings!

I'll just have to keep my fingers crossed!!

The funny thing is that most people who are,or have been,in an IVA are a good risk as they are diciplined with budgeting.
