Hi

I am in the process of looking at an iva

I have accounts with empre and littlewoods home shopping but have not signed a credit agreement, will these also go into the iva or only accounts where credit agreements have been signed.

Do i have a choice ?

Please advise

This is an interesting one. A debt whereby a signed credit agreement cannot be produced is I think UNenforceable.

I have seen a case of TESCO money wrote off 8K as the debtor asked for the credit agreement.It could not be produced.The debt will still be recorded on the creditfile though.That I a sure of.

Ask you IP and do a serach on the net on consumer credit agreements.

I think you will find that as long as they can prove that they sent you the document it will be enforcable even if you did not return it.Also there may be a clause in the original application form to this effect.
ALL unsecured debts MUST be declared in an IVA,you do not get a choice

I cant remember if I signed a credit aggrement for JD williams, but better to include it.
