Hello
Well had a chat with mu mum last night and if i cannot repay the car im in big trouble, i wont be able to work either and so stressed and worried, also i pay my mum £90 a week which includes all my food and board towards the bills does that sound to much , my mum said that it will cost me more if i have to move out

Hi Lisa
Please tell us a little more about your current debt difficulties so we can advise further.
As far as your board and lodgings with your Mum is concerned I'm sure this will be considered an allowable expenditure.
If you need a car you will be provided a budget for one in bankruptcy.
Best Regards
Oliver

Have you had a meeting with the OR yet. Food and board at home is always a difficult thing. I told my kids a third to live a third to save and a third to spend. Bear in mind none of them ever stuck to it but they did pay a third for living at home. It would cost a lot more to live on your own. May I ask why you cannot work is it due to illness.

Lisa I don’t see 90 a week as totally unreasonable, although it will depend on how much you earn.

Oh gotcha. I see no reason why the OR would not allow the car as oliver says it should be an allowable expenditure if needed. Have you met with the OR yet or still waiting. Everyone is always really nervous about that part but it never seems to be as bad as they thought. Only my opinion but as you dont have a lot of the other living expenses such as council tax and water and gas and elec then hopefully the Or will allow the car as a necessity for work.

Hello Oliver
I had an IVA but it didnt workout due to the firm i went with

My debts are about 5 years old i have never missed a payment to any agreement.
I sought advice and was advised my best option was bankruptcy as i have no assets, i was made BK on Monday with the support of my lovley boyfiend
No im scared, my mums circumstances have changed and she cannot finance the car i asked her to get for me while i was in an IVA, my old car constantly broke down and i did not have enough to keep paying, my mum got me a little car which i tax, ect and i pay her £111 a month, im nearly 30

so mum thinks i need to start paying my own way which i must admit she is right !!!!
So please can anyone tell me is the payment for the car ok ?? and is my rent to mum ok at £90 a week all in ??
Thanks
Lisa

I think that your rent and board will be fine as an allowable expenditure.
You will need to discuss the car cost with the OR though as the agreement is in your Mother's name. I feel that £100 month is not an extraordinary amount to pay for the use of a car, but this decision will ultimately rest with the OR.
Best Regards
