Mr orignal debt was in my name but the IVA was done as jointly if when we go BR does this mean my husband will too or is it just me.

Your debts are your own and your husband's are his in bankruptcy proceedings. I don't understand why he is in an IVA if he has no debts, can you clarify the position, ie how much do you owe personally, how much does your husband owe personally and how much is jointly owed.

Hi Melanie,
Basically all the debt was in my name, but my husband was included in the IVA all the credit cards, loans, the only thing that was in his name was the Bank accounts so total debt for him if split would have been no more than 2k. Looking back on things now we were so naive at the time we just done what was asked and never questioned anything as we believed that our IP knew what was going on.

I would not recommend that your husband goes bankrupt if he only owes £2,000. See if he can try and service those debts directly, if your IVA variation is not accepted.
