HFC just phond and told me if the iva is Accepted the wont go with it and i must still pay them or the put me in court and sand the balifes in can they do thes ? sorry about my spellings

Hi
This is just the sort of rubbish that you sometimes get from call centre staff who are paid to collect money.They probably don,t know the difference between an IVA and IVF.
They WILL form part of your IVA,if you get the required votes,whether they accept it or not.

If they are included in the list of creditors and IVS is accepted They are BOUND legally to accept IVA arrangements.
Tell them that.
On acceptance,IVA is registered in court and becomes legally binding on all unsecured creditors listed in IVA proposal.
Make sure ALL unsecured creditors are included.
Double check and check and make sure all unsecured creditors are included.

Ooh that made me laugh Andy! HFC tend to be a very supportive creditor once the proposals arrive at their insolvency specialist department, and they are represented by Grant Thornton who are an excellent accountancy firm who will advise them as to the merits of your IVA properly.

HFC are one of my creditors and were represented by Grant Thornton. They also had the majority regarding votes. All creditors voted yes to my IVA proposal - Grant Thornton also voted yes at 29p/£ with an equity release in year 1 of £13k, and 24 hours later changed their mind stating they required a minimum return of 41p/£!!!!!!
As other posters in various threads mention - we will sell anything and anyone to get the IVA approved!!! As for IVA vs IVF - not sure about either anymore!!!
If HFC is not your majority creditor and all your other creditors vote yes, HFC will have to just accept it.

Historically HFC have been very responsive to IVA proposals and the information you have been given is totally inaccurate.

The people that phone and harrass you are not the same who vote for the IVA anyway. They were one of my creditors and I found them to be very insistant and were relentless.
Hi its nice to hear from you sadsack, I have been wondering about you. I do not think the comment was aimed at you but some of these call centres dont seem to know what an IVA is or their ass from their elbow, me thinks.

Gavin - Its true the people who are harassing you on the phones are not the people who vote in your IVA, they wont even see it. They are just employed to get payments from you. All you need to do is explain that you are entering an IVA and that you will not be making any payments, you could also refer them to your I.P.
