1 of my creditors wont stop phoning me they phone 4 to 5 times a day and the now put it out to door step colector i tell them them them i i doing a iva and wayting for creditor meeting but they wont stop the man at the door says he can take my car and good if i dont start paying him a min of £40.00 a week can they do this?[:(]

Have you spoken to your company about this, does the doorstep collector have any court orders etc, I think this is just tactics to get money out of you.

The only person entitled to enforce a court order is an officer of the court / bailiff.

Door step collectors are not entitled to use threatening or intimidating practices to collect debts.

Next time they come to your door ask them politely to go away you will not discuss the matter with them, you will not be making any payments to them nor do they have any right to be on your property.

If they persist inform them that you will be calling the police and making a complaint.

Who is the creditor ??

no they have no court oders sponk to my iva company and the phone them but the sad the wont stop till the iva

The phone calls may continue but be strong, stay polite , make sure they log that they have called you that day and if you have caller id I would answer them once and then not again that day. If they are rude or threatening tell them you are ending the phone call and put the phone down. I just used to give my ref no and refer them to my company. Its par for the course unfortunately, dont let them get to you hopefully it wont be for long if the iva is approved the calls will soon stop.

i used to say exactly the same barclay card were really horrible to stop. i'm sure my ip phoned them once to make them stop.

Barcalycard were horrible with us really bad they said someone would come to door and get money, i telepohoned greg penn and they got it stopped i was in a DMP then

I am surprised that Barclays used such tactis.I am now in IVA ,before that they were one of the silent ones once I informed of IVA.I think then it was referred to Mercers.

Morgan stanley used to phone me almost every day.

Door step collectors are un usual.I am surprised that Barclays used one.

Out of curiosity how much do you owe Barclays.

Inform the door step caller that you would call police,no one can call or threaten to take things unless it is court appointed Balifs.Even then they can not force entry only if you let them in or they canngain acces through an open window.
Balifs can only enter forcibly if they had gained entry before.

The person who threatens to take things,it did would be comitting an act theft.

Remind the person and dare them .

that it mercer they are the 1 working for barclays and if any comes
through an open window my dog will have them

Mercers arn't a bailiff so they wont try to gain access through an open window or use force to enter a property.

They do however have self employed door step collectors - simply tell them to go away politely, you will not be making payment or dicussing the matter with them.

They can't force entry nor can they take your vehicle or any other property.

If they threaten or intimidate you to extract the money they are committing a criminal act.

Barclaycard are one of the most supportive creditors of IVA's - so the sooner your IP gets your proposal prepared and issued the better.

yea it was mercers we got all the hassle from, but as soon as somone from greg penn got on the case they stopped.
