hi
I am coming up to my 3rd year in a IVA.
I currently pay the IVA and a remortgaged loan.

My ex is currently paying the mortgage.
My ex has contacted me ref a divorce, which I do not have a problem and he has offered to carry on paying the mortage for the length of the IVA, but said that his lawyer has expressed he should not be paying anything towards the home etc, our daughter is 19yrs and not considered a dependant. However, I feel a bit trapped and nervous for the future, I cannot take on the extra monthly payment, We are not able to sell and I doubt there is any equity in the property. I realise he is under no legal obligation but I fear I have come so far down the line and will end up bankcrupt and homeless. sorry for the ramble.

Hi Rachel welcome to the forum and well done for doing so well with the IVA.

I can't answer your question, but couldn't you approach your IP to submit a new I&E form, as your circumstances have changed. Your payments maybe adjusted accordingly. Try not to panic, you'll get plenty of advice in here. [;)]

Speak to your ex again. Just because his solicitors have advised him he doesn't need to pay does not mean that he cannot if he wishes. He has expressed a desire to assist you. Take him up on it. If you can combine this with a variation which will allow you to alter the payments into the IVA, this will also assist him. Whatever you can reduce paying on the IVA you can contribute to the mortgage.

As in all cases speak to your IP.

Steve is right. This should be about you and him coming to an amicable agreement about the future which suits both of you. There will be no need for a variation if you both carry on as you are - and this should not affect your applications for divorce.
