Hi, my husband and I are on IVAs, he works full time but I only have Disability Living Allowance. The company he works for are having a month's shutdown so all employees are being laid off. They are paying him one week's pay in the first week but then nothing for the next three weeks and when they go back after the month they are going on reduced hours and, consequently, reduced pay. They have been told that in the three weeks in which they are not being paid at all they cannot claim money from Social Security. Is this right, because how on earth are we supposed to live on nothing?

I think you need to speak to your IP and explain the situation to them. You could ask to miss a payment now so that you can live.

Once he goes back and you know what his wages are going to be, then you could do a new I&E and see if you can get your payments reduced.

I think that the company should be paying you while you are laid off. You need to speak to CAB to find out exactly where you stand as I am not really sure.

Your employer, subject to the terms of your contract of employment, may be required to pay you a Statutory Guarantee Payment of £20.40 per day for the first week you are laid off - and can only do this once every three months. After that you should be entitled to claim benefits.

Thanks Melanie and everyone else. My husband wishes they would just close the place so he could get his redundancy and look for a better job but he won't just leave as he's worked there for 35 years and would lose a lot of money.

Sounds like he may come under the "temp stop" umbrella of making a claim to benefit - tell him to contact his local jobcentre for more info - if he has a letter confirming it it may make it easier to sort out. My friend had something similar last year happen and that is whay I know the above.
