Hi,,, once again,, how are you all...
now,, i have a question to the experts please.. my husbands IVA was accepted same date and time as mine was accepted.. his current account is with barclays,with an overdraft and a personal loan on his own name, the rest of his debts (personal loans)are joint account with me and credit cards which are on his own name as well.. we were told by our IP, the chairman of the meeting, after the meeting, that voting wise my husbands IVA shouldn't be accepted but since he has big amounts of joint debts with me they have considered it and accepted otherwise.. BARCLAYS did not vote at all, the meeting was on the 8th of January 2007, and today my husband received a letter from Barclays dated 10th of january 2007,saying that they have been informed about the IVA , a default notice enclosed , and a letter demanding to pay the whole amount of my husbands barclays personal loan and the rest of the owed money mentioning legal actions, going to the court etchetera, etchetera, very scarry really,, and now it is just mixing up our mind, knowing and being informed that IVA has already been accepted and now still chasing us up to pay the whole amount..HOW THIS COULD HAPPEN,, i know letters, demands will still keep coming but BARCLAYS seems not bothered with the IVA..to be honest i do feel guilty because my husband shouldn't be in this mess if not because of ME due to family crisis and the world turned upside down,,please does anyone banks with BARCLAYS as their main bank and have the same experience right after IVA was accepted.. anyone..please give me an assurance..to this matter

Hello Lessie

If both you and your Husband's IVAs have been accepted you are legally protected by the IVA and Barclays can not demand full payment from you. Speak with your IP and also send a copy of the paperwork your IP sent you notifying you that your IVA has been accepted to Barclays.

Hi Lessie

Oliver is right. It is a sign of the times that the left hand does not always know what the right hand is doing within the banks. Refer these matters to your IP - that is what he or she is being paid to do. It also does not do you any harm to send a lette to Barclays confirming the existence of the IVA, quoting the Court number as a reference point.

Let us know how you get on with this, as I regularly meet with the creditor's representatives and can bring these things to their attention.

thank you for your replies..one thing more does it happened that 1 account could have two account numbers? my husband has 1 abbey credit card and definitely just one.. the account number which is in the proposal is the same as on the bills that they have sent and with the cheques to be paid to MBNA Europe..now they sent us a letter saying that inspite of numerous reminders of the payment no reply from us and this is with the different account /reference number they used but i am pretty sure it is the same abbey account but different from what is in the proposal..how odd..

Try not to worry about any payments demands and default notifications.

As Oliver said, you are covered by the IVA. To put your mind at ease, my IVA was agreed on the 21st Dec. Despite this, all of my creditors, with the exception of Natwest(the only one to vote) are still sending letters demanding full payment and informing me that people will be visiting and they will be taking legal action.

I have looked at this as a desperate move by the creditors, they obviously didnt like the IVA being agreed even though they couldn't be bothered to vote and wouldn't reply to any communication from my IP. Serves them right realy.

It does take time for the oficial notification to filter to the right debt at your creditors, a bit of a flaw in the system but it happens.

I have been told by my IP to forward any nasty letters calls onto them now. So I dont even discuss anything on the phone with them, just give them my case number and a contact number for my IP and hang up.
