If I thought I had very good grounds for being mis-sold an IVA, what exactly would I have to do. Who would I go to to see about it and would I just keep paying into the IVA until it was sorted? Also, if I was successful in my claim, what would happen then?

Have you by any chance received a letter telling you you may have been missold an IVA?

Errors made in the proposals, which the company have admitted, and taking a year to try to sort it out and then still expecting to get all the money from 50% additional income based on their mistake. These are just a few reasons that make me think it has been mis-sold.

I'm not sure that's classed as mis-selling your IVA, more like they have made errors which need rectifying. If they have admitted the errors but have not correced them then you really need to speak directly with your IP about it first, as opposed to the admin staff. You can find your IP's email on
www.insolvency.gov.uk in the "find an IP" section. If you have tried all that then I think you can complain, an expert will be able to tell you who to. X

Thanks. We did email the IP a couple of months ago but he passed our complaints on to the company who then investigated our case and now I feel we' not really any further forward.

Isnt someone who posts on here often used as an intermediator between ip's and customers who have problems,someone will know his name!!!

I dont know if you are referring to Ian Millington. He has in the past contacted peoples IP's if the particular IP is somebody he knows.
jc4, i would suggest contacting your IP again and keep contacting him or her untill you recieve the answers you need. Tell him/her that you will make a formal complaint if things dont get sorted out soon regarding the mistakes they made.

Hi jc4 -
Just a bit curious - you say that there were "errors" in your proposal. A proposal is a mega-important document which ties you in for 5 years. Obviously any one due to sign one will read it over and over again to make sure it is spot on BEFORE putting their signature to it . I read mine about 10 times to make sure it was all in order before signing. Obviously - none of us are under any committment to sign a proposal we do not agree with.
What were the errors that arose further on?

You seem to feel that the way that you dealt with your IVA should be the "norm" for all. Your view is that anybody taking on an IVA should have thought about it very carefully,researched thoroughly and above all must be thankful to ther creditors that they have been allowed to enter into an IVA.
To be honest I am tired of your views and postings and as such have decided to remove you from the forum

Well done Andy. This person left me stupid messages as well.
Anyhoo I am in the process of reporting my IP for mis-management.
I contacted the Insolvency Service and they said they do not deal with complaints but referred me to The Insolvency Practices Council and the Financial Ombudsmen.
My IP mis-managed my IVA for two years and then helped himself to £5000 worth of my contributions for his fees.
I have written a 5 page complaint and have gathered emails and letters as proof that he has mis-managed my IVA and I will be sending a copy to him and the MD of Debt Free Direct as well as a copy to The Insolvency Council. I hope I get somewhere.
And I hope you do as well.
