hi i am a self employed plumber and pay tax thru the construction industry scheme, i am about to do my self assessment and will probably get a tax refund. is this classed as a windfall or not as i see it as just tax i have overpaid. please help as my ip cant give me a straight answer.

You can only really get the answer for this from your IP as I imagine different IP's may treat this differently, even if it's just a tax refund, if you hadn't have paid that tax in the first place you would have had extra disposable income that if you couldn't offset it against essential expenditure it would have gone into the IVA anyway? so I can why your IP isn't giving you an answer yet as they are probably waiting to see how much this refund will be before committing to how they will deal with it
