Hi all, hope you're well,
I'm hoping I've just got pre-creditor meeting paranoia here...[:I]
Received a letter this morning from Mercers debt collectors, stating that they have received advice that "I am to enter into a voluntary arrangement/bankruptcy order".....
destroy and return cards/cheques immediately etc. etc.
The bit that has worried me is the letter ends
"Please send a copy of the bankruptcy orderwhen it has been approved."
Is this just general terminology as no-one has voted yet, or should I be extra prepared for a creditor (Barclaycard) looking to make me bankrupt?
Apologies if I sound hysterical, just desperately wanted the IVA and not bankruptcy

Sounds about right for Mercers ignorance to IVA's - they probally dont know the diffrence.

I would not worry about it to much, they have probally sent you the wrong letter or are using it to scare you into backing out of an IVA and making a payment plan with them.

It is very unlikely that a creditor will make you bankrupt, they would much prefer you to continue to pay as they are not likely to get back very much in BR. If a creditor makes you bankrupt then it will cost them approximatley £1,000 in legal fees and they are not going to do that.

I would forward the letter to your IP and let them deal with it for you.

Have recently not responded to a message on the answerphone to contact them immediately, so I guess I could have ruffled the Mercer feathers eh?
I'll pop it in the post to my IVA co. tomorrow.

Carl, do you find Mercers are a very tough cookie to deal with? Barclaycard (Mercers) are my only creditor threatening me. The other creditors are very supportive and non threatening nor judgemental. This morning at 8am Mercers rang me and I informed them as I did a few days ago when they rang that my IVA meeting was on Friday and she said, well you'll need to ring us to tell us the outcome or the doorstep collections begin on Saturday! I personally am not too worried about the doorstep collections (after posting on here for advice) but for others who do not have the good fortune to be a member here it would terrify them. They did ask for a minimum payment of £50 to keep the collectors away! I said sorry I can't pay and you will find out the outcome of Friday in due course and she finished with, we look forward to your call on Friday afternoon!

To be honest if a client tells me that Mercers are being pushy (as they normally are) when we appoach them, provding there is an meeting booked they will leave alone until after that date.

They are very clever in the way they write letters and come across on the phone, they will lead people in to thining they are taking court action but normally they are just saying this is what could happen (and never does)

If you find they are becoming a problem then best to speak with your IVA company and get them to apply the same pressure back.

I can afford to leave it at the minute Carl but thanks for your response as my meeting is on Friday but they have been the only ones as I said that have caused me any grief.
