my house was repossessed in 1997, the halifax have passed my debt of £9000 to a collection agency, i dont work and my wife is on a low income and tax credits. what can i do?

Are you on benefits?

Unfortunately a mortgage is a deed, therefore the 6 year rule is extended to 12 years. So firstly the debt is valid.

I assume you are on benefits? In that case I would go and see the Citizens Advice Bureau and ask them to help you make yourself bankrupt.

thank you so much for getting back to me, i went to the citezens advice and they wer'nt particularly helpful!
i beleive bankruptcy costs around £500? if so, do you pay that in instalments and do you think thats the best thing to do?
We are on benefits (working & child tax credits) but my wife claims them as she is the one who works. Also we get disability allowance for our son.
also, how long does the whole bankruptcy process take?

Hi Brian
If you were both on the mortgage you will both need to declare bankruptcy.You should get a reduction as you are on benefits and I think that it will cost about £350 each.
I will post details of some charities that may be able to help you with the cost.
Once you attend court on the date that you are given for your bankruptcy hearing you will be declared bankrupt that day and the debt will be no longer enforcable.Also as you are on benefits you will not have to pay ongoing payments under an income order.
