Hi,

I wondered if anybody can give me any advice as I'm really worried about it?

We've recently had our IVA approved with modifications and one of these was that it would be reviewed when our eldest (just turned 4) goes to primary school.

We have 2 children and they are in full time nursery - this amounts to £1,100 per month.

However, before we started the process of an IVA, we had looked at private schools for our eldest who is due to go to school in Sept 08. Forms have to be completed and submitted by Oct 07 and the process for the IVA was not started until late Nov 07.

The major issue that we have now is that our daughter is not registered at any local primary school and it is unlikely that she will gain a place.

The private school is cheaper than the nursery and we would be able to increase monthly payments slightly by £150 to £200 per month.

But now I'm really worried that creditors can insist that she doesn't go to the private school originally chosen and I don't know where that will leave us

Any help or advice would be greatly appreciated

Did the proposal diclose the fact that you were looking to send your daughter to private school and the cost implications of private education?

I am not familiar with the process of registering for a state school place (As I do not have children). I would suggest you make enquiries with those first and determine the position - either she can be admitted or not. There's not really a great lot to be done until the answer to that question is known.

At the end of the day it will ultimately be up to your IP to decide whether the private education costs can be justified. To persudade him/her that they are, you will need to explore the position regarding local state primary schools - and there are some very good ones - and demonstate that you have made every effort to fully explore the state system.

This is something which would have been sensible to disuss with your IP prior to the IVA proposal being presented. I wonder if you did this and, if so, what advice you were actually given.
