Has anybody out there ever got money from the child tax credit when you owe them money (overpayment)????? When you have been in an IVA???


I don't really understand that if you have taken the CTC overpayment in with the debt, you therefore should recieve child tax credit???


Please let me know??[?]

Current HMRC policy is to recoup their debt by witholding future entitlements to the benefit concerned.

I thought only a percentage was taken worked out on which elements of tax credit you recieve??? I read something on their website.

Thanks for that. I think this is a very grey area and I feel they should pay out??
However if they do pay you, the IP take 75% of it so I am not all that concerned at the moment.

I have to agree with Melanie on this one, that usually the procedure is if you owe money in Tax Credits that your payment will cease until the debt is recovered.

Hi I was overpaid tax credits to the tune of about £8000 in the first year CTCs were introduced (its a long story but they never paid any attention to my change in circumstances). Although the payment was stopped for the rest of that year (because I had reached the entitlement for that year), in all future years I have been advised I will pay back 10% of my monthly allowance until I have paid it all back. I suppose if I still have an outstanding balance at the end of this time I will have to pay this in a lump sum.

I was overpaid £3,000, tax credits and my payments went from £119 to £14, whilst they recoupe the overpayment. I was told they can't not pay you anything at all.

I can only imagine that they are different type of entitlement.

Hi
I was overpaid by approx. 1500.00 and they stopped my payments for almost 2 years until they recovered all the overpayment back.

Hi

Received a letter today stating that I owe nearly £500 in overpaid tax credits for period end 5-4-04. This is nearly 4 years old and the information would be near impossible to check now by me as being accurate. I called the helpline and asked what is the timescale that they would apply to right off any money that is potentially overpaid. The lady said they could ask any time, so I gave an example of sending me a letter in 2028 and she said she didn’t know. I realise it was a silly example but I was just trying to find out the cut of timescale, can anyone help or offer further guidance.

I don't think that they can ask you to repay anything that it older than six years ago, but would have to check to be sure.
