Hi

I'm really annoyed today I received a letter from a firm of solicitors saying they had been instructed by a collections agency to commence county court proceedings against me for my overdraft which was part of my IVA agreed in October 2007. I must admit I was really cross and phoned them, of course no one there but left a meesage stating that if they could inform their clint I have an IVA which they voted in agreement for which commenced in October and corrected their file, and also they could phone me to apologies for sending the letter, as if they will!!!

Just wanted to get that off my chest and see if anyone else has had this, I was so cross as it is over 2 months sicne the IVA began and I have had no contact from anyone before this, i will contacting my IVA company on Monday to sort this out and earn their money.

I wouldnt worry too much, its probably just been a bit slow filtering through the system and christmas post wouldnt have helped. Just forward the letter to your IP.

If they continue to contact you, let your IP know.

Creditors who aere included in an IVA are not allowed to contact you once the IVA has been approved.

We recenlty had a problem with one on the Banks due to their comms system breaking down between departments. We ended getting an apology from them and a cheque for the costs of sorting it out. The funds received went towards the time costs that we had incured in sorting the matter out.

There is nothing to stop creditors contacting you, but they cannot take any form of legal proceedings against you. This is tedious, but simply is a result of communications delays within the banking system.
