We missed Decembers payment but can pay it in January so no problem? also we havent had our review sincew last september when it was due they didn;t send us a form and we didn't remind them ,last year my partner earnt a couple of grand more but l had to have three months off work with a bad illness and am still undergoing tests for cancer etc. so more of less the money remained the same are we in trouble for not telling them all this?with 5 children to look after as well it just wasn't something we thought about till now.

Hi Derek and welcome to the forum

I can't see a problem with your earnings being used to supplement periods of unemployment, but it is strange that you have not received an annual review. Which firm are you with?

we are with Debtfreedirect. We are worried sick that we are going to be in trouble for not having a review should we ring them and ask them why ?

I suggeest that you just call them, ask to speak to the person dealing with your case and ask them for the review form, if it doesn't arrive, then you can write to them to advise them of your change of circumstances.

If you later get into difficulty because they change the level of payments and try to backdate it to when the review should have been done, then you have grounds for complaint. Until then you can legitimately continue with your payments at the existing rate.

All Insolvency Practitioners are subject to regulation by certain authorising bodies, the threat of a referral to their authorising body is usually sufficient to make them back down if it was their error.

Hi Derek,

Write them a letter explaining you have not been contacted for your review. Wait a few days and then call them to confirm they have received it.

This way you are covered if they want to back date any costs you can fight it.

If you phone them they may say they did not receive your callat a later date.

Don't meant to be a doubting thomas but have learnt over the years that companies always lose info when it is in our interest but never lose things when it is in theirs.

Just cover yourself where you can.

Not sure why, but DFD have asked is to complete annual review forms after three months! When i asked they said it was our projected rent of £800 was now not this and actually £100 less per month therefore our whole I&E had to be reviewed - surely we could just have paid the extra £100 into the IVA rather than review the I&E after three months?
