I am in process of an IVA but still receive calls from my creditors. When are they going to stop calling me?

It is highly likely that you will still receive letters and phone calls until your IVA is in place. Once the IVA has passed the meeting of creditors and is in place, the creditors can not contact you by law.

Once your IVA has been approved you are legally protected from your creditors taking further action against you for recovery of the debt, or adding further interest or charges to your accounts.

During the setup of your IVA you may have calls and letters from your creditors. We ask that all letters are sent to your case advisor who in turn can contact them directly for you.

If the IVA fails then creditors have the right to pursue you.

Unfortunately it can take a bit of time for creditors to update their records once they receive notification of an IVA. A lot of correspondence which is produced by your creditors is on an automated system and so this can continue to be issued after the IVA has been approved, which can obviously be very distressing.

However when you are in the process of an IVA or after you have had the IVA accepted at the creditors meeting you should give any creditors who contact you the details of your IP and explain that you are in an IVA or proposing an IVA.

Forward any correspondence to your IP who will deal with the creditor directly.

As long as you provided your IP with details of all your creditors at the proposal stage and you pass on any further correspondence to your IP these creditors should eventually stop calling or contacting you.

I'm in a Trust Deed (scottish IVA in a way)My Trust Deed was 'Protected' on the 13th July. Now one and a half months later I am STILL getting calls. I tell them I'm in a Proteced Trust Deed and that they are not supposed to contact me, but they say they have nothing 'on screen'. I KNOW these people have received notification that I am 'protected' but still "try it on". Does anyone know if they are breaking the law by doing this. I have been taking the persons name or badge number and tellephone number and passing onto my IP who sorts it out. But surely there must be something else I can do on the 'phone to shut them up?

Sadly this problem is likely to be occurring due to the fact that many of the "larger" credit companies have numerous systems which don't "talk" to each other. This can mean that your personal details are not correctly updated on all systems and you can still get calls from your creditors. The best thing to do is continue doing exactly what you currently are. Every time you receive a call ask that person to update their relevant systems so you don't receive another from their department.
