I have been contacted by someone called the IVA council suggesting i was mis sold my iva because iva's are intended for people who wish to protect assets i.e. house, business. Is this the case? i have none of these and they out me in touch with a company who suggest i should go bankrupt. I'va been in an IVA's for nearly 18 months now

Hi carl.s and welcome to the forum

This is quite possibly the most popular forum topic at the moment, as many of the posters have received similar letters.

Can you confirm which IP firm you are with, as they seem to target a different one each week. Do you feel that you were mis-sold your IVA - or are you happy with the arrangement and the fact that you are actually going to be paying something back to your creditors?

IVAs are most certainly not intended just for people who wish to protect assets. They are there for responsible adults to avail of who have an appropriate level of intelligence to make decisions of their own, rather than been spoonfed the nonsense that this firm and its professional representatives dish out.

The main aim of the IVA Council is to get you to stop making your IVA payments, so that money can be diverted to an associated company - UK Bankruptcy Limited - who wish to charge you for assistance in filling out some rather simple paperwork, if you do decide that bankruptcy is a better option for you than your present arrangement.

Most people who receive theses letters completely disregard them, however a few vulnerable individuals, who may be led by the attraction of not having to pay any more contributions, may be led into believing these people are really trying to help them.

Hiya Carl and welcome. Ask yourself two questions.
Are you unhappy with your IVA?
Do you want to declare bankruptcy?
if your answers are no then I would suggest you ignore the letter and advice given and carry on the way you are,
xx

Hi Carl and welcome. If you do a search you will see a lot of posts on the iva council. Your letter probably says they think you have been misold your iva and they appear to have details. They got your name and company from the insolvency register, are you with freeman jones we got letters this week too. If you are happy with your iva and managing why change anything, you would have been referred to uk bankrupcy I think it is . Personally I would tell my Ip and bin it. Which is, as I might add, just what I did.
