can you bankrupt seperatly we have a joint personal loan together of 24000 i have a couple of debts myself but wot if hubby is against bankruptcy can i do this on my own or does it have to be both of you

Hi there, If only you go bankrupt, then they will look to your husband to pay the joint loans , the bankrupcy will cover you but not him.

Its like having an overdraft on a joint bank account, if 1 is bankrupt - the bank will look to the joint holder to pay x

i have got a appointment at cab on 18th march so ill wait til then to make any decisions has i am not able to go into a iva or dmp because there is no disposable income left over has i have 3 kids has well my hubby is full time i work part time(we dont earn a lot) i would have rather have paid the debts back but if br is the only wtg then i have no other option

Your hubby will be chased for the loan, he is as liable as you and they will chase for the full amount.

It may be that he has some fears that are not actually founded and perhaps some reassurance may help him with the decision
