Hi all hope you are all well .Well iva running smoothly almost 2 years in and managing cautiosly but comfortably .Here comes the dreaded spanner ! Iv just recieved a letter from hmrc who advise that I owe my share of a split benefit overpayment from an ex from back in 2011 ! .They are persuing the debt by passing it onto the dwp which apparentley have more powers to enforce the debt .I had totally forgotten about this ! .They are asking for 1560.00 be paid back .I have to await the dreaded letter from dwp in next few weeks .So how do I go on with this ? .Do I await the letter and contact them advising of my insolvency and will this be added to my debt in my iva as obviously I cant pay them this ammount also it might invalidate my iva if I tried to do so favouring creditors etc .Do I tell them and pass my details of my iva company which is currentley ebenegate acca vanguard .? Do I give them my reference number for ebenegate or the details of peter jsckson the ip ? .Do I need to phone ebenegate or email peter jackson ? A little confused of what to do .Im currently paying 388 monthly but this will probably rise slightly at next annual review as iv had a small pay rise of 145 monthly since my last review .Any help on this matter would be greatly appreciated hope you all having a nice evening .

HMRC / DWP are treated differently to 'mere mortal' creditors and, if it has to be repaid asap you might be able to negotiate a payment break from the IVA ( which will be tacked back on the end).

Bit of a fly in the ointment dealing with Ebenegate, who seem to have difficulty with a straightforward IVA --- Lord knows what they will make of this ! Personally I would be inclined to deal with Peter Jackson, as the named supervisor. After all, he is still where the buck stops !

Thanks foggy .So its unlikely they will put this debt into my iva .Still I need to advise them of it .Could I negotiate a payment installment with them based on the Iva would this jepordise my iva ? Iv just about managed to save this ammount I could pay it but all my savings would be gone after 2 years of being carefull .Also Would this jepordise my iva by doing so ? .Always something to put a spanner in the works !

If im honest I dont want to add extra months onto the iva I want it over asap .But agreeing to monthly installments to repay this debt would obviously add to my expenditure which will surely be picked up on my annual review .Just when things were running smooth bump !

This has put me on a bit of a downer as I thought Id got it all sorted .Such is life and its rollercoaster !

I wouldn't do anything without reference to Mr Jackson ( and a response in writing).

No help whatsoever, but it makes my blood boil the way government departments can trawl back decades to correct 'errors', whereas we taxpayers can, usually, only go back a year !

Thanks foggy yes me too just when you are getting your life sorted boom ! Well il have to try and deal with this the best way I can .Il inform them of my insolvency cant get blood out of a struggling stone !

Government approve ivas but then still make you struggle so it seems !

Sometimes im thinking as hard as im trying to repay my debts id be a lot better off swallowing the bankruptcy pill at least it would all be over sooner .I have no assets an old car less than 1000 pounds and I rent my home .I could afford the bankruptcy payment Id just need help completing the application ! May be jumping the gun a little but Id probably be better off in the long run ! Iv tried to do my best and pay off what I can .This could really jeapordise my iva thought I was doing the right thing now im doubting it .Well il keep you posted see where this next unexpected turning takes me on my journey

IVA's are nothing to do with the government regardless of what you see on the net. It seems a shame to fail after this time. If you did go BR then you would probably have an IPA for three years and your credit would be shot again for six years. Think carefully.

Thanks think Il negotiate with them see what they can come up with maybe a small monthly payment but it would have to come from my allowances I guess they will want to see my expenditure .I really dont want it to fail as iv just been getting back on my feet !

Just a quick update on the dwp overpayment issue I contacted them and advised of my situation .They have agreed to a small payment of 25.00 monthly for 52 months which will be six months after hopefull completion of the iva .I will have to fund this out of my i and e and iv decided to go down this route as already explained hmrc debts are treated differently. Its a releief although an unexpected surprise .If in my next review they try to increase payments I will try to offset them as this additional monthly expenditure whilst keeping the iva running smoothly I think il just manage .I dont think ebenegate will even know what the hmrc are to be honest ! Its in the best inteterests to all to keep the iva running smoothly hopefully they will see this at review next feb ! Thanks again for all your invaluable advice everyone !
