Will my IVA provider know I have moved out?

Hi Everyone,

I am in an IVA and have been for the past 1.5 years. I have a mortgage (in MY name only) and live with my Girlfriend & Child. My girlfriend and I are both on the council Tax here.

We are separating and I am going to leave the house with them, but carry on paying the mortgage / bills as Normal and I’m going to live with my parents so I will be going on the council tax at my parents.

So nothing will really change apart in terms of my income and expenditure, My girlfriend will get some help from working tax credits as only working 30 hours a week and we have a 3 year old.

Me moving back with my parents but still paying the mortgage / bills on my house, but coming off the council tax here and going on the council tax at my parents - will my IVA IP be made aware some how? Will this cause problems?

My ex girlfriend will be claiming working tax (but I don’t want to take any of this money) as she will need to learn to drive etc. - will this cause any problems? Ie, my IVA provider will want this money to come to me to up my Iva payment etc?

Sorry if this doesn’t make sense, I’m just worried the HMRC & My IVA provider will communicate and want to know why I’m paying for a house I am not living in. And also if my girlfriend is getting help with benefits, why she isn’t giving me some of that money etc.

It is better to just be straight with your IP as things with your I&E will be changing and you are obliged to inform your IP of any change of address.

You could move to your parents and use the house as a postal address and your IP might not notice, but then HMRC might make enquiries regarding your ex partners tax credits / benefits claims and decide that you still reside there, which could stop the benefits being paid.

There wouldn’t be any changes at all with my I&E. everything is exactly the same on my side. So I feel like I don’t need to mention it?

In terms of my ex claiming working tax credits, some of the credit is ‘towards household’, it will be just like private renting, although I won’t be taking the money off her.


Abit of weird one,
- just don’t want my IP to expect me to pay more for living at my parents, although I&E still the same.

- Don’t want my ex partner to get in trouble for getting working tax credits which include ‘help towards household’ because I’m still paying for the mortgage/bills.

When I come off the council tax their and go on at my parents, I’m wondering if my IP, or HMRC would communicate and this would become known.

Are HMRC one of your creditors ? If not, they would not be communicating with your IP, nor should the council as they are only involved during the tax year in which the IVA started. But ... things have a habit of coming out of the woodwork !

No HMRC are not one of my creditors. Sorry I’m thinking the council tax goes to them 😂.

Yeah that’s what I’m worried about things coming out of the woodwork and questions being asked, mainly for my ex partner and her claiming working tax credits.

On my side, I’m still paying my mortgage / bills - as my IP can see from my bank statements on the annual review.

On her side, she’s going to get X amount of working tax credits and not paying towards household. (Because I am, as stated on my I&E)

So only change what’s going to happen is the council tax - so if, I was worried if the two communicate, there could be some complications/questions.

Don’t want her not to be able to get the help she needs just because i have an IVA.

Your moving into your parents will not have any bearing as council tax goes on the property and not occupancy.

Council tax is done on the property regardless of who lives there. You may be on the electoral roll there but if it is your parents address, the tax will be in their name.

Hey thanks for the reply.
I understand what you mean, however when I come off the council tax at my house. They are going to want to know where I’m going to stay?
