HMRC Claim

Just when I thought it was all done!

Back at the end of July I contacted Freeman Jones to get a figure to close my IVA. They told me £6800 and that was to bring it up to 100p in the £. I paid the figure that I was given.

I've just had a call and they're now telling me that HMRC have lodged a claim for £3600 for unpaid tax assessment penalties for 2011 to 2013. There was an automatic entry on the IVA for £1 for HMRC.

My question is where do I stand with this?

By paying the settlement figure that your IP provided, you were basically agreeing to pay the balance of the debt, as it stood at that time .... unlike a full and final which would have drawn a line under it by creditors agreeing to accept the amount offered and calling it quits .... with the settlement, no one has called it quits and HMRC have put in a final claim, so the debt balance increased and that quoted amount no longer covers it.

HMRC are treated differently to other creditors, so I would advise that you have a word with the IP to see where things lay.

Cheers, Foggy. Sneaky! So would I have been better arranging it as a F & F, even though it would have been the full amount?

Oh well. I'm guessing they can't close it down now. I guess they must have contacted the creditors, told them I'd paid up and HMRC said "Ooo... hang on a minute..."

But a debt that's at least 7 years old that I have absolutely no communication about? They even gave me a tax rebate about 3 years ago.

I did ask the person I spoke to on the phone. She just gave me a reference number and the phone number for HMRC saying that I would have to take it up with them.

Oh well, I'll try and do a deal to pay it off over 3 months or something. At least I had one month without my IVA payments :D
