Lodgers

Hi All

My lodger has just moved out.

I need a review to adjust my payments as they take this into consideration as income.

Good lodgers are rare to come by especially when you have an over bearing dog. In not sure I'll fine anyone suitable quickly nor I'm not sure whether I also want another one. Will my IP insist I get another one?

It would depend on the overall picture and how much of what the lodger paid was actually counted toward your IVA payment. If the reduction is significant the creditors might suggest you get another and might put this in as part of an agreement to accept any reduced payments in the meantime. If they do, I would suggest that the wording be, not that you will get another lodger, but that you will seek a suitable lodger. It would be in nobody's interests if you were panicked into accepting a total unknown into your home and, in my eyes, not a reasonable request.

I am afraid that you will need to have a chat with your provider ----- I wouldn't mention getting another right now --- just see if they accept the change and reduction for what it is. They might just agree to reduce payments accordingly. Under the usual terms an IP has the discretion to reduce by up to 15% without consulting creditors, any more than this will require a variation meeting.

I didn't have a lodger at the start of my iva. I got one about a year in and not I've just past my 3rd review.

Does that help in anyway? That I didn't have one at the beginning?

Presumably your payment increased when you got the lodger, in which case there should be no problem reverting to the initially agreed payment levels.

My payments doubled. I assumed they would just deduct the payment I was being paid from my income and my payment would reduce by the lodgers paid amount.

I've sent 3 emails now and rang twice and no response. I guess I'll just keep trying.

I'm just worried as I wont be able to afford to pay my next payment.

I was told today that they want to extend my IVA by 24months....how is that even right?
Does anyone have any experience of this?

Have they said why ? Exactly why -- not some nebulous flim-flam.

Hi Foggy.

No reason....except for that its a large reduction and they need to hold a variation a meeting and they will say it will be extended.

I said it was extremely unfair and that i needed an reason...and nothing. They said they would call me Monday, so now i have to have the weekend feeling awful.

I just wanted to gain some other peoples experiences and knowledge so I could back up my case.

They do not need to go back to creditors if the reduction is back to your original payment level .. THAT payment is what the creditors agreed to. The extra they have had since is a bonus. The IP can agree to a reduction up to 15% below the initially agreed level without reference to creditors, assuming you have the usual clauses.

Thank you that is so useful to know.

Yes they will be getting over £100 a month more than my original agreement as my salary has increased over £10k. So they are still winning.

When I spoke to them they made me feel like rubbish in the terminology they were using. They have ruined my weekend.

AT least I can go back with that now. Fingers crossed on Monday they have reviewed my case fairly and I won't be passed around numerous people.
