IVA completed six years ago and a letter out of the blue today

Hi

I completed an IVA between 2008 and 2013 and everything seemed to go OK. Today I have received a letter from a company called Robinson Way asking me to contact them about a debt of approximately £1000 passed on to them from GE Capital. Obviously I am completely stunned to be contacted after all this time. Any advice would be much appreciated. I still have all my IVA paperwork of course.

Phone them and tell them you have competed an IVA - you can also send them a copy of your completion.

It may well be an admin error on their part.

It could well have got mixed in with a lot of sold on debt and they either didn't realise or they are simply trying it on. I am assuming the debt to GE was included in your IVA. Do as Kallis suggests and let them know the bad news.

I assume that the debt was unsecured? If so a entirely agree with previous comments.

Thanks for the replies everyone. I didn't feel up to a phone call so sent a letter to Robinson Way including my completion certificate, and made sure it was signed for.

Today I receive another letter chasing me for the debt, dated three days after they received MY letter. No acknowledgment at all of my letter. This debt was clearly in the IVA.

Should I contact my IP company? I'm getting really worried now that a perfectly completed IVA counts for nothing.

You are quite safe as they cannot come after you for a debt included. It may be that right and left hands haven't a clue. Email, write or phone and threaten them with harassment if they don't desist.

As has been said they cannot pursue this debt and, as I mentioned in my response above, they could simply be trying it on. Some companies have been know to ask for an old debt in the hopes that someone will fall for it.

Keep a record of the correspondence to date, send the CC again by recorded delivery and then just ignore everything from them. Let them do the running about, you can then claim compensation from them if it ever gets to summons or court appearance for harassment and distress. If they ever send anyone round to your address then they are doubly liable to pay you compensation. A bit stressful, but you are fully covered and legally clear of this debt so have fun and lead them a merry dance.

Bear in mind that Trust Deeds are different to an IVA in the UK.

Hi everyone I thought I'd revisit this thread to thank everyone for their advice. It's now three and a half months since my second letter to Robinson Way confirming that the debt was in the IVA, and I haven't heard from them once in that time.

I assume they are not in the business of sending out letters saying "our mistake, we apologize" etc.
Do you think I should request something from them to that effect, or let sleeping dogs lie so to speak?.

I agree with Kallis -- bears and sharp sticks should be kept apart !
