Final offer rejected by CreditFix are trying to overturn

One of my major creditors have rejected my F&F and my variation meeting has been adjourned. I have offered £5,000 for my £5600 left to pay (My father is gifting it to me as I have been mentally wrong through all this!) Creditfix say they are trying to overturn their decision - is this likely?

As I mentioned on a similar thread, Creditfix appear to get themselves into these corners much more often than other firms, but they do often also manage to turn the vote around by getting other creditors to overturn a refusal. Good luck.

Creditfix cannot 'overturn' a creditors decision, although they can try and convince the creditor to change their vote.

Hi Lisa,
Me again - coming back to this. I am due my annual review any time now and based on the result of that I am then hoping to offer an F&F - again! My father still has that 6000 in a pot for me to get rid of this IVA.
If you remember then great - but if not totally understand as you have hundreds of cases on here (as it were) but to cut a long story short - I made an offer of 5000 for 5600 of remaining payments as an F&F - it was rejected as I was told the creditors would receive a better dividend if i continued with the arrangement. We went in with a higher offer - well 5600 and again it was rejected.
This was 3 months ago so I have paid 140 x 3 more into the arrangement so my remaining payments will be now about 5180 (these are quite round figures) so if I was to make the same offer of 6000 then do you think this has a possibility of getting accepted?!

Katie -- I cannot for the life of me imagine why your
first offer was refused, and even more confused about the increased offer !!! I do have my suspicions, however, that it might be linked to the debacle over CF amending the standard paperwork in these cases, which resulted in them having to cancel all variations until it was sorted out --- which it may not have been !
I wish you all the luck in the world with a new offer.

Thank you for coming back to me Foggy - OK so based on what you saying (purely based) you are assuming that because this is so unusual they may have said no because the meeting was never actually held? I never got a report despite asking them 3 if not 4 times?
Thank you for your support on this as I am also very confused! What would you personally do in my shoes?

My, albeit second hand, anecdotal, experience with this firm, based on numerous posts here are that you can never pin them down to a reason for anything !
Personally I would lodge a formal complaint regarding the lack of feedback from this supposed meeting and, failing a credible response, I would then escalate this to their regulatory body. Unfortunately, as things stand in the industry, this is the only recourse we have.

It's really hard to say how creditors will vote again given, as Foggy says, it was surprising to hear they didn't accept the first 2 offers.
Can you remind me why you are trying to finish the IVA early rather than carry on and make your contributions to the end of the term?

Hi Lisa - thank you for getting back to me. There are lots of reasons really - mainly for being able to get a new car on finance (mine is about to die and I need a denet car as I do between 500-600 miles per week) - about to try and rent a place with my partner - life is changing quite drastically for me and the restrictions of an IVA are not helping! And - it sounds extreme - but my mental health has not been great either as I am get anxious at the best of times and this whole process has really accentuated it.
But I really am hoping this time it gets accepted as I am starting to think - WHY ME? Other success stories are great to hear of course but also a wee but depressing. Also I have not out a foot wrong since the start of it - all payments made on time etc but it seems that if you have missed a couple in the past creditors seem to accept anything offered as they see this person clearly struggling so is happy to get anything out of them! Where as those who make damned sure that payment is met through any means are not treated in the same way - is that me being deluded?

Professional Behaviour when she failed to ensure that
correspondence from solicitors acting for a creditor, between

I'm not sure you will be able to get a new car on credit, even if you finish your IVA early. I suspect you will still have to wait for the 6 year anniversary to pass.
