New Debt whilst in IVA

Hello everyone,

I have been in my IVA for nearly a year and have since had a problem with Vodafone. Due to a change in circumstance I have been unable to pay my bill and wont be able to afford it in the future. I have contacted Vodafone and explained the situation and asked if they would be able to reduce my tariff at all due to the change in circumstances and they have said no. I also explained to them that I am in an IVA however they have refused to do anything. I cant afford to pay the monthly bill so therefore it will create a new debt. Can this be included into my IVA even though its a new debt please? What will happen when I don't pay my bill. I have wrote to my IVA explaining the situation however haven't had a reply yet, I also have wrote to Vodafone explaining too.

Hi,

Not sure about this but you should certainly speak to your IVA company to see if this can be included.

It is possible that this debt may be included if the contract began pre IVA. If not you would need to make an allowance to repay it monthly but only your own IP could answer for sure.

Further to Michael's advice, if all else fails, you IP might agree a payment break to cover the termination penalties with Vodafone. This would be added back on to the end of the IVA.

In the past my clients have had a similar problem but have been able to get it added into the IVA. Get in touch with IP and they could tell you for sure what your options are.

You may be able to get a reduction in your payments if your circumstances have changed,

Thank you for the replies. I have contacted my IVA company and explained the situation and they have said that because the debt has been incurred after my IVA was approved then there is nothing they can do to help at all! :(

I take it they won't even give you a payment break to help with this?

Thank you for the reply, they haven't said about that but a payment break won't help as I can't afford to pay the bills for Vodafone anymore. My IVA is comming upto the annual review so I will fill in the new expenses etc. Me and my wife are due a little girl on 5th June so her pay will drop dramatically. I thought the IVA would be able to help but I guess if they can't they can't. The only thing I'll have to do is battle with Vodafone to except an amount I can afford and they can cancel my lines.

Ah, OK ... I am not familiar with them. If you cancel the phone contract you will have the usual penalty clauses and will have to pay a lump sum penalty plus outstanding charges. Surely your IP can entertain a payment break to enable you to clear this. It is not as though it will lose the IVA / creditors / IP any money as it will be added back on at the end. To refuse is simply being churlish and says nothing for their compassion.

It is possible, but the IVA has to be terminated first. Have a word with CAB who are DRO intermediaries.
