IVA Companies trying to grab 30% years after IVA completion court certificate issued!

My IVA successfully completed 5 years ago. The court report indicates that and says there will be no more reports this is ended.

Now my previous IVA company DFD says they have cashed a cheque for PPI.

We never were asked about ppi ever and never signed a deed of assignment. There was no proviso in our end of IVA court report for anything to do with ppi which ends all communicatons with our previous IVA supervisor and which is legally binding.

DFD should not have cashed a cheque which did not belong to them. They are not complying with Green v Wright. Until this is overturned this is a legal precedent whether IVA companies like it or not.

Green v Wright is the latest presedent whether you like it or not all you IVA companies raking in millions.

Whether you like this or not you should be complying with the law.

Simple as GET THIS ANYONE HAVING PROBLEMS POST IVA WITH THESE companies are money seeking SHARKS!!

Unfortunately, until the judges make a decision as to who keeps funds post IVA, this will be an ongoing issue.

I can imagine how frustrating it would be to find out that an insolvency company has received a cheque for funds and cashed them, without knowing 100% whether they should have done, even after closing an IVA down, but I can only think that these will be returned to the debtors if a judge makes a ruling in the debtors favour.

Personally I think it does depend on the company too, as we've had ppi since finishing the iva and have been told we could keep it, so I wouldn't say that all companies are sharks.

Iva companies once again riding roughshod over the paying customer.

The treatment at times is an absolute disgrace.

Many IVA companies set up PPI claim management companies or jumped on the band wagon to encourage reclaiming.

It will be hard for them to prove or justify the fees associated with this but then again creditors allowed them to get away with it.
