I was hoping someone could give me more advice. For those who have read my previous posts, you will know I was fortunate to have been awarded £21.5k ppi refund. I have just received a letter from CF saying they have called a variation meeting with my creditors for 'The supervisor be authorised to close with distributions made to date'. I take it this means they are asking to complete my IVA? With the letter is a break down of receipts and payments. Totals are receipts £40,429.22. This includes the £21.5k ppi. Payments £39,375.21. CASH IN HAND £1,054.01. Will I get this amount back if the meeting is successful? Also, in the breakdown of payments, there are 2 payments relating to ppi. Successful PPI claim fee £8,632.03 and PPI External consultancy £250.00. I did not use a claims company nor my IP, I did the PPI reclaim on my own back, so why do I have to pay the above charges? Any help will be appreciated.

Sounds as though they are looking to close with this PPI.
If you pay back the total debt plus fees, then anything extra will come back to you. Don't see why you should have to pay back a company which you have not authorise and I would challenge this.

I have to pay my normal monthly payment of £270 plus around £258. Will I get this back as well if the meeting is successful?

Hi - your IP is asking creditors to accept everything to date in f&F and close your IVA. You will not get any funds back as these will go towards payment of the debts, interest and costs but it does mean if the variation is accepted you shouldn't have to make any more payments into the IVA.
The PPI costs don't come out of your pocket, they are approved by your creditors and effectively come out of the creditors pockets/dividends.

I emailed CF today and queried the £8.6k ppi fee. I was a little shocked at the reply I got. When my case was transferred to CF, my details were passed on to EIC to investigate any PPI claims I had and they are due these fees. EIC did nothing, I reclaimed my PPI on my own back and CF have asked me to send proof of this. Surely EIC cannot put a claim in for these fees as they did nothing. If they are trying to claim these fees, surely this is fraud? Why have I got to send proof? Surely CF would check with EIC or are they just making an assumption that EIC did all the work?

It may have been other PPI claims they were investigating, but as you have raised it your Supervisor should investigate this. In sending them the evidence that you did all the legwork will be very useful to your Supervisor.
In any event you have a duty to cooperate with your Supervisor and without proof it could be EIC's word against yours.

If eic have never been in contact with you and you have never signed any authorisation forms they were only authorised by the ip to start the process.
We all got hit with a charge whether we have heard from them or not and cf never fully explained the process.
Additionally I believe eic was owned by cf at one point.
You would have grounds to complain to the relevant regulatory authority.
Cf is still not very good at the process.

I am starting to mistrust CF. They seem to do a lot of things underhand. As for proof, what can I send in? I didn't keep a copy of the application form, I never thought I would need it for this. I could contact Lloyds who paid out the refund, to see if they could provide some sort of proof.

Getting a bit concerned now. CF have gone quiet on me. Sent a couple of emails to them trying to prove EIC were not involved, but I have had no reply. My creditors meeting is on the 16th and the variation packs have already been sent to them showing the £8.6k ppi fee. What happens if this is not resolved before the meeting?

Keep pressing them - phone and email constantly - you need an answer.

Put in writing that you do not wish the variation meeting to take place until these issues are resolved.

Update. I kept on at CF and finally got an answer regarding the charges for PPI fee and good news, the fee has been refunded to my case. Even better news, it was the variation meeting with my creditors and they accepted the f & f with funds paid to date. My IVA is finally over (subject to completion certificate) No more payments. Time to start living again, debt free.

I think CF are pretty quick at closure, so shouldn't be too long.
