Hiya, I have finally finished my iva which began in 2009 this month.
I have begun to look into a credit file clean up.
However I have a question re a defeault on my credit file.
As I said I began my iva in 2009, I had a loan from Nram from the start in the iva, Nram were also my mortgage provider.
To cut a long story short in early 2013 I surrendered the keys to the property, Nram agreed to include any shortfall from this in the iva prior to me doing this.
Like I said above I already had a loan from them in it also since 2009.
Anyway today I have checked my credit files to find that the mortgage is in closed accounts and shows as default but satisfied with zero owing.

Can I get this default changed to the start date if the iva?
As I understand it all defaults should be dated fron the start of the iva.
If so how do I do this?
I was told before that as the debt is bound by the iva any default will have to be taken off after completion.
It's been 6 and a half years since the start now and me and my partner want a fresh start in life.
Any advice in very grateful for.

Hi,

Get in touch with them and enclose a copy of your completion letter. Tell them to remove any defaults back to the start of the IVA and it should then drop off.

Do they have remove the default even if the debt/default was created after the start of the iva?

The default should not have started after the date of the IVA as far as I am aware if the debt is incuded.

That's what I'm hopin is correct and they remove it when I send in my completion certificate to them.

Yesterday I phoned Nram to speak with them re this default on my credit file.
To be honest the guy who works in collections dept just said it will stay on file but only for 6 years.
I said but what the debt was included in my iva which has now completed but he said no it will stay on.
Now I got off the phone a bit cheesed off to say the least.
I don't want to give up on this , and I know getting this off (if possible) is going to be like pulling teeth.
What's the best way of doing this?
I think I need to quote Act and section of the insolvency act 1986, if it says anywhere in there that defaults should be removed.
Does it say anything like this in the Act?
Nram in my experience have always been the hardest creditor to work with, but they were quick to get there gov bail out!

Biggest problem is that the debt was added into the iva 4 years after it commenced and therefore technically the default date is correct.

Foggy thank you I will have look at this.
What gets me is that I discussed the surrender fully with Nram prior to giving the keys back and I paid the mortgage in full every month until I sent the keys back.
I never actually defaulted on a payment.
Really I think they should have just took ownership and sold it.
Nram ain't losses a penny as the debt went into the iva and is shown as satisfied with zero owing.
