Can I hold an Alcholic licence for a shop ?

I have one. Although I've had it since before my iva. But I can't see how a iva will effect being a licence holder.

I think it depends on what sort of licence it is - I forget which one you can't hold but one of the experts will be along to help.

I believe you can hold a personal licence but not a premises licence but not sure if that just applies to bankruptcy or an IVA too.

I think it applies to an IVA as well but not 100% on that.

ST1100 is correct. You can hold a personal licence or be a designated premises supervisor but you cannot hold a premise licence. The licence will lapse and you can no longer carry on licenced trade so if you are considering an IVA you need that licence transferred first.

In many cases the premise licence is held by the brewery if it is a tenanted or licensed pub so there is no problem but if you have a corner shop then this could be serious. Make sure and use an insolvency firm with experience of the licensed trade.

Is this only whilst in the IVA or if you have EVER had one ?

My IVA is complete now, could I hold such a licence ?

I think it is during an IVA - once you have completed you should be ok.

It is only while you are officially insolvent so you can reapply once discharged. However there is no guarantee that a new licence would be granted post insolvency so it would be worth taking advice froma specialist lawyer should that ever arise.
