I entered a IVA in Jan 2008, all cleared and completed March 2014.

Now my question is this, I have had MBNA contact me reference PPI sold to me on a loan in Oct 2005, this loan was all paid off early and was never included in the IVA.

If I was to get a refund would I need to tell them please.

Technically, yes. Even though the loan was not part of the IVA the refund is deemed an asset that existed ( albeit unknown) at the time of the IVA.

You could speak with your IP and work a deal. It is unlikely that your IP can reclaim the money without your assistance so ask for a 50/50 split and you will go ahead and make the claim.

If the IP says no then you would be under no obligation to claim and no one gets anything so worth a try.

You are under no obligation to assist with PPI reclaim so as Michael states you could strike a deal with your previous IP

So how long does this go on for, get my life back on track and I am buying a house so any extra funds will help yet I have to give it to them.

I never knew about the loan and first I heard about it was when they contacted me.

Can I complain to anyone, any refund will only be around £145

At that amount your IP may actually just disclaim it and give you something in writing to that effect. It would cost more to process the payment and divide it among creditors so contact your former IP and ask them for a letter confirming they have no interest and that might suffice.
