So its been a while since I posted on here but things have been getting to me a bit recently.
Ive had personal issues the last few months making keeping to financial obligations difficult but I have managed it just.
Anyways In Autumn last year there was the possibility of some overtime at my work which comes up rarely. Previously I had done a little and paid half of it to Payplan. I made quite a bit extra over a couple of months but it took a lot or extra shifts to do it. But I did all the extra I could knowing that both mine and my wifes cars were having issues that wre going to need sorting sooner rather than later. I made just enough to cover the work to my wifes car and when my car had a terminal failure and was economical to repair I could get another cheap run around (£1100) with a little help from my dad. I made Payplan aware of where the money had gone to show we hadn't just squandered it. They told me initially to get them a letter from my garage to confirm my car had been uneconomical to repair, nwhich I had done but now they are still demanding over £500 from me, which they say I can spread over the next months or so for an extra £92 a month, which I really cant afford or they can look at adding onto the end. Im already paying over 6years. They asked of I would have the opportuniuty for more overtime which I don't. I just feel what was the point in me working so many hours to cover issues I knew were coming up, rather than leaving it till both cars died and I had no money to repair / replace. Im at my wits end and don't know what to do. sorry for the rant.

Unfortunately Payplan are within their rights, per the terms of your IVA, to expect half of the extra earnings. I imagine they are a little miffed at being presented with a fait accompli and might well have agreed to the outlay, or a payment break to cover the car purchase if asked beforehand.

Your best bet is to put up with having the arrears added to the end. As frustrating as it might feel it is better than having the IVA fail.

I understand how you are feeling but at the same time agree with foggy ... telling them after the event was probably not the right thing to do. Add it to the end and don't let it hinder the rest of your iva

The thing is about 9 months ago I had to have lot of work done to one of the cars & knew then that it was going to continue having issues and wa never going to live the span of the IVA and I voiced my concerns about this to Payplan. In Oct they asked for 3 months payslips which they've never done before, this wasn't a problem so I just gave them the slips, had the extra money to one side ready and by the time they decided to let me know how much they wanted the car had died and so I needed to get it replaced, admittedly maybe I should have explained the situ to payplan before spending the money but tbh I had no faith in when they would respond with a decision and I cant be without a car. Hey ho, guess Ill just have to take it on the chin. Got to admit though if overtimes comes up again I'm in 2 minds whether to do it as I don't even get the first 10% to myself. cheers for the advice guys.

I was the same as you, Ketton, with no 10% -- but the 50% still came in useful !

Sorry we couldn't be more helpful .. but life in an IVA isn't a bed of roses.
