Hello,

I need help and info....
My second IVA payment has come out. Long story short.
I sent in all over all the documents and more via email and some via post before the end of my first review.
I was then told my first payment would be the highest payment and the difference would be refunded. The second payment would be at the lower amount.
Freeman Jones have taken the higher payment for a second time and this has now left me overdrawn and with bank chargers and direct debit charges.

My question: Can I now pass these charges back to the IVA company? and if I do will they just lump them on my final year IVA payment?

You could contact your bank and claim under the direct debit guarantee, the bank will then claim off the Freeman Jones. I think going by this route it would stop the bank charges.

This may not go down well with Freeman Jones though (I'd think they would be charged extra for having a claim under the direct debit guarantee)

Has your IVA actually been agreed or are these instruction/upfront fees ?

The IVA does not have upfront fees.
It was the normal monthly payment.
I was informed that the second payment after my review will be at the lower amount.
I have never looked into the direct debit guarantee.
What I do want is to know why the wrong amount was taken.

I do have to say that Freeman Jones have always processed everything through and listen to me.
It just like other I was worried about what happens and did not know where to turn out of work outs.
